1. Purpose and application of general terms and conditions of sale

The following provisions establish the general terms and conditions of sale for the products offered by the company BLESSED on its website at the following address: www.blessed-raffia.com.

The Customer must be aware of the General Terms and Conditions of Sale (GTCS) prior to placing any order, as the GTCS are available on the website. BLESSED reserves the right to adapt or modify these GTCS at any time.

Clicking on the icon “I accept the general terms and conditions of sale” means that you accept these general terms and conditions of sale.
Clicking on “Validate your order” confirms your order definitively.

BLESSED is a sole proprietorship with its registered office in Soavimbahoaka-Antananarivo, Madagascar.

The purpose of these general terms and conditions of sale is to define the reciprocal rights and obligations of the parties, as well as the various stages of the order process, exclusively for the purposes of the relationships they establish on the Internet.

By ordering on the Site, the Customer declares and guarantees to BLESSED that he/she is of legal age and has the legal capacity to contract. Customers ordering directly from https://www.blessed-raffia.com must follow the following procedure:

– Fill in the form (Billing details)

The customer will then receive an e-mail confirming the order. BLESSED will acknowledge receipt of the order as soon as it has been validated by e-mail or by any other means at its convenience, in accordance with the provisions of article L121-19 of the French Consumer Code.

In the event of an error in the recipient’s contact details, BLESSED cannot be held responsible for the impossibility of delivering the Products.

After having validated the method of payment, the customer definitively and irrevocably validates the order with the effects indicated below:
– Payment by bank transfer or payment by cheque/cash
– The customer validates his address, the product(s) and the total price.

2. Site information and accessibility

www.blessed-raffia.com is an e-commerce website owned and managed by BLESSED.
The website is accessible to all internet users 24/7, 365 days a year, as a general rule, except for scheduled or unscheduled interruptions by BLESSED or its service providers for the needs of its maintenance and / or security or case of force majeure (as defined below).

BLESSED shall not be liable for any damages of any kind resulting from the unavailability of the website.

BLESSED does not guarantee that the website will be free of anomalies, errors, or bugs, nor that the site will function without breakdown or interruption. In this regard, BLESSED may freely determine, at its sole discretion, any period of unavailability of the site or its content. BLESSED cannot be held responsible for data transmission problems, connectivity issues, or network unavailability.

BLESSED reserves the right to modify to the website for technical or commercial reasons. Where such changes do not materially and adversely affect the conditions under which services are provided, the Customer may be informed of such changes that have occurred, but their acceptance is not required.

4. Products

The products offered for sale are those described on the site on the day the customer consults the site, while stocks last. These details are updated automatically in real-time. However, BLESSED cannot be held responsible for any errors in updating, regardless of their origin.
In this regard, BLESSED cannot be held responsible for the cancellation of an order for a product due to stock depletion.
In the event of unavailability of a product that has been ordered and paid for beyond 45 days, the customer will be informed by email. The cancellation of the order for this product and its refund will be processed, with the rest of the order to remain firm and final.
BLESSED does not guarantee the accuracy or security of information transmitted or obtained through the site.

5. Price

Prices are indicated in Euros and Dollars.

They include any discounts and Value Added Tax (VAT) applicable on the date of the order.

The prices indicated are guaranteed within the limits of available stock, except in the event of major changes in charges, in particular VAT, and except in the event of a typographical error or omission.

BLESSED reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in effect at the time of order registration, subject to product availability.

The products remain the property of BLESSED until the full payment of the price. Customs duties for orders outside of Madagascar will be charged to the customer.

6. Payment

The amount due by the customer is the amount indicated on the order confirmation sent by BLESSED to the customer via email. Unless the server is unavailable, payment will be made immediately online by credit card (Visa).

Currently, we are unable to accept payments made with American cards as well as those made through the Revolut payment solution.

In any case, BLESSED reserves the right to refuse any order or delivery in case of an existing dispute with the customer, total or partial non-payment of a previous order by the customer, refusal of payment authorisation by credit card issuing banks, or non-payment or partial payment.

BLESSED’s liability cannot be incurred in this regard.

The amount due by the customer is the amount indicated on the order confirmation sent by e-mail by BLESSED to the customer.

In any event, BLESSED reserves the right to refuse any order or delivery in the event of an existing dispute with the customer, total or partial non-payment of a previous order by the customer, refusal of authorization of payment by credit card by banking organizations, non-payment or partial payment.
BLESSED cannot be held liable in such cases.

7. Delivery

Delivery terms

Delivery times vary according to the quantity ordered. International delivery is free of charge, but BLESSED reserves the right to charge an additional cost for excess weight or for any other necessary reason, which the customer accepts through these GTCS.

All orders will be delivered by DHL, guaranteeing quality of service and the possibility of being tracked, thanks to a tracking number.

In the event of a delivery delay exceeding 30 days, BLESSED cannot be held responsible, but the customer may cancel the order and request a refund.

DELIVERY TERMS :

Duties and taxes:

Deliveries to countries other than Madagascar may give rise to the payment of duties and taxes levied by the customs service on arrival in the country. The customer is responsible for paying these taxes.

In the event of a refusal to pay these taxes, the customer will be responsible for returning the package to BLESSED in Madagascar to receive a refund. The refund will be processed once the package is received.

The customer can contact the tax and customs department of their country for more information on the amounts to be paid.

The products are shipped with the delivery note, to the delivery address provided by the customer during their order.

DUTIES AND TAXES :

Deliveries to countries other than Madagascar may give rise to the payment of duties and taxes levied by the customs service on arrival in the country. The customer is responsible for payment of these taxes.
The customer may contact the tax and customs department of his country to obtain further information on the amounts to be paid.
In the event of a refusal to pay these taxes, the customer will be responsible for returning the parcel to BLESSED Madagascar in order to receive a refund.
The refund will be made once the parcel has been received.

8. Returns and exchanges

Upon receiving their order, the customer should check the conformity of the products received. Any anomaly regarding the delivery (missing product or damaged package) must be notified to BLESSED’s customer service department on the day of receipt, or at the latest on the first working day following receipt, by e-mail or registered post to the following address:

Any claim made after this deadline will be rejected, and BLESSED will be released from any liability. BLESSED reserves the right to request that the customer return the defective product.

BLESSED will process a refund (or exchange) in the following cases:

The product delivered to the customer is defective.
The product received by the customer does not match to the order validated on the website (size, colour, model…).

Procedure:
After reviewing the customer’s request (and any supporting photos), BLESSED will inform the customer whether the request is eligible for a refund.

If the request is accepted, the product must be returned in its original condition, with the sales tags still attached, in its original packaging, along with the original invoice. The product should not have been used or worn, damaged, washed or cleaned. BLESSED reserves the right to reject any product that does not comply with the above conditions.

All product returns must be made within 2 days following the receipt of the email confirming eligibility for a refund (or a return) of the order.

Refunds and return shipping costs will be made by bank transfer, once the product has been received by BLESSED. We encourage the customer to use a quality service with a tracking number to ensure reliable delivery conditions.

BLESSED cannot be held responsible for a lost or damaged package returned by the customer, and no refund will be processed in such cases.

9. Product availability

The products offered by BLESSED are valid as long as they are visible on the website within the limits of available stock. Information on product availability is provided at the time the order is placed.

In the event of a product becoming unavailable after the order is placed, BLESSED commits to informing the customer by email as soon as possible. The order will be automatically cancelled, and the customer will be promptly refunded if their account has been charged. The refund will be made directly to the customer’s bank account within 15 days of the payment received from the customer.

10. Right of withdrawal

In accordance with the law, the customer has a right of withdrawal of 14 days to return products without having to justify the reason, in accordance with the provisions of Articles L 121 and following of the Consumer Code. This period runs from the receipt of the goods. This right is exercised by returning the product (return costs will be charged to the customer).

If the customer exercises their right of withdrawal, BLESSED undertakes to refund the sums paid within a maximum of 15 days, according to the chosen payment method.

In accordance with the general terms and conditions of sale of BLESSED, only items returned in their original packaging will be accepted. It is the customer’s responsibility to retain proof of return. The right of withdrawal is exercised under the same conditions both before and after delivery.

11. Intellectual property

All elements of the website are and remain the intellectual and exclusive property of BLESSED. No one is authorised to reproduce, exploit, or use, in any way, even in part, elements of the website, whether they are visual or auditory, including the underlying technology. These elements are protected by copyright, trademarks, or patents and are the exclusive property of BLESSED.

Hyperlinks may refer to other websites than the site BLESSED manage. BLESSED disclaims any responsibility in the event that the content of these sites contravenes current laws and regulations.

12. Data processing and civil liberties

For the proper processing of the order, the personal data collected will be subject to a computer processing, and the consumer acknowledges being aware of this. In accordance with the law of January 6, 1978, the consumer also has the right to access and rectify any information about them contained in BLESSED’s files.

This computer processing has been declared to the CNIL (French data protection authority).

13. Applicable law and jurisdiction

This contract is governed by Malagasy law. The language of this contract is English. In the event of a dispute with professionals and/or merchants, the courts of Antananarivo will have jurisdiction.
